Tanto la preservación del patrimonio arquitectónico como la accesibilidad física, sensorial e intelectual y comunicacional son reconocidos como derechos humanos. Cuando una persona o grupo encuentra condicionada su posibilidad de acceder, usar y disfrutar determinados espacios, sus derechos se encuentran vulnerados. Esto perjudica, principalmente, a personas con discapacidad, personas mayores, personas gestantes, niñas o niños, y tiene un impacto en la vida de todas y todos porque nadie está exento de necesitar condiciones de accesibilidad en algún momento de la vida. (...) Sin embargo, garantizarla en edificios protegidos no es tan sencillo como en una construcción nueva, y la legislación cumple un rol importante que es necesario analizar. En el caso de Argentina, y particularmente de la ciudad de Mar del Plata, se detectan grandes vacíos legales y una notable falta de articulación entre las temáticas, lo que impacta en la realidad material de sus construcciones protegidas. El objetivo de esta investigación es revisar y aportar a ese marco legal desde el enfoque de derechos para convertirlo en una herramienta acorde a los paradigmas actuales, con perspectiva de discapacidad y perspectiva de géneros. Empleando una metodología principalmente cualitativa, recopilando y estudiando de manera crítica una selección de normas que abordan el binomio accesibilidad y patrimonio a escala internacional, nacional y local, se busca contribuir a proteger los valores de los bienes y democratizar su acceso al mismo tiempo. De acuerdo con la tradición dominante de la teoría generativa, la creatividad lingüística es la capacidad de producir infinitas oraciones a partir de un conjunto finito de instrucciones sintácticas. Aunque esta idea de creatividad ha sido aceptada y festejada, sólo se trata de manejar una secuencia de categorías y escoger en cada paso un miembro de cada categoría. En efecto, la así llamada creatividad generativa no es más que una operación secuencial que ofrece opciones para cada punto de la secuencia, (...) y esto es comparable a la operación secuencial en la que completamos la bandeja con la comida disponible en el comedor. De hecho, la creatividad generativa no puede dar cuenta de los procesos verdaderamente creativos, por ejemplo de la invención de palabras nuevas o nombres originales. Por el contrario, el enfoque neurocognitivo asumido por la teoría de redes relacionales sí puede dar cuenta estos procesos genuinamente creativos. En este trabajo se mostrará cómo es el proceso neurocognitivo gracias al cual se crean y se entienden nombres cuya originalidad se basa en la ambigüedad deliberada. (shrink)

Revisión de la tesis Orígenes y consolidación de la Asociación Madres de Plaza de Mayo de Mar del Plata (1976-1989).

La investigación etnográfica se ha desarrollado ampliamente en las últimas décadas, ha sido adoptada por numerosos campos del saber: sociología, psicología social, historia, y otras disciplinas sociales. Desde una perspectiva amplia y tradicional, la etnografía puede entenderse desde una triple acepción: como método, como texto y como enfoque (Guber, 2014). Nos interesa retomar esta última acepción dado que nos conduce a reflexionar en torno a su complejidad, más allá de la palabra dicha, recuperar los gestos, sensaciones, emociones, miradas, sentipensares que (...) dan sentido a los acontecimientos cotidianos. Las múltiples dimensiones de conocimiento que se ponen en juego en el trabajo de campo en tanto experiencia vivida (Quirós, 2011) como investigadores pueden ampliarse y debatirse a partir considerar el hecho de "dejarnos afectar" como instrumento metodológico. Acompañar y comprender los procesos socioeducativos en la escuela secundaria, su cotidianeidad, integra experiencias que constituyen, desde cada sujeto particular, acciones significativas de producción y reproducción social y apropiación cultural, así la vida cotidiana abarca gran cantidad de actividades mediante las cuales estudiantes, docentes, padres dan existencia a la escuela dentro del horizonte cultural que circunscribe cada comunidad. El texto que sigue compendia reflexiones alrededor de lo educativo y lo pedagógico a propósito de procesos y proyectos de investigación en curso del Grupo de Investigación en Escenarios y Subjetividades Educativas (GIESE) de la Facultad de Humanidades de la Universidad Nacional de Mar del Plata. En los protocolos de la investigación académica este manuscrito puede inscribirse en el género “artículo” a condición de que se conciba en el marco de una etnografía previa de larga duración, lo que supone (...) un conjunto de conversaciones en las cuales varias corrientes “teóricas” y experiencias de trabajo de campo intra-actúan—para codificarlo en términos realista-agenciales—en pos de producir relatos que puedan conmover o inspirar otras búsquedas. El artículo utiliza la imagen de la canción para proponer una inmersión en lo que se acuña contingente y provisoriamente como “arqueologías biográficas”, con el fin de estimular la imaginación respecto ciertos modos alternados y alterados de performar la investigación educativa. Desde mediados del siglo XX, el devenir de la salvaguarda relacionada con las viviendas ha avanzado desde la monumentalidad hasta el contexto, desde la individualización hasta la caracterización paisajística, desde las condiciones materiales hasta los aspectos vivenciales. Sin embargo, amparar el cuerpo de las residencias típicas de cada territorio, en especial en los dinámicos marcos urbanos, resultó —y resulta— un desafío. Las experimentaciones de propuestas hacia un amparo residencial a más largo plazo han coincidido en dos aspectos de interés: la (...) promoción de indicadores de sustentabilidad patrimonial, inscriptos en cada marco estatal-local preservacionista, junto con el reconocimiento y el tratamiento del rol usuario. En este sentido, desde variables histórico-arquitectónicas y sociales se propuso la construcción y la aplicación de indicadores de sustentabilidad patrimonial residencial para visibilizar problemas y potencialidades hacia una formulación de estrategias de preservación apropiadas. Para ello se abordó la ciudad de Mar del Plata, una aglomeración intermedia bonaerense paradigmática debido a sus dinamismos pasados y presentes, con foco en sus chalets “estilo Mar del Plata” y sus usuarios. Se analizaron dos barrios históricos —Stella Maris y La Perla—, donde sobrevive una relevante diversidad de chalets en un marco de múltiples riesgos que afectan su permanencia. Desde una perspectiva principalmente cualitativa, apoyada por datos cuantitativos, se articularon relevamientos in situ, fuentes escritas (investigaciones previas, artículos científicos, cartas patrimoniales), gráficas (planimetrías, fotografías, imágenes aéreas) y orales (encuestas, entrevistas). De esta manera, la indagación desarrollada permitió avanzar en renovados caminos para progresar en la salvaguarda del legado residencial contextual. (shrink)

Este artículo explora mi devenir como indagadora narrativa en la educación superior. Se trata de una aproximación íntima a las formas teóricas y metodológicas en las cuales, dentro de mi grupo de investigación en la Facultad de Humanidades de la Universidad Nacional de Mar del Plata, Argentina, hemos recogido relatos sus docentes y estudiantes para estudiar entre otros temas, representaciones sobre el currículo, buenas prácticas de enseñanza, docentes memorables, identidades y experiencias de docentes en ciernes. En el transcurso de (...) este devenir indagador reconocemos, en este orden, estaciones de cruces con diversas metodologías tan narrativas como íntimas: investigación de narrativas; investigación con narrativas; investigación biográfico-narrativa; indagación narrativa; indagación poética; autoetnografía; indagación narrativa visual. Examinamos los vínculos metodológicos y teóricos entre qué investigamos y relatamos, cómo lo hacemos y lo re-presentamos y quiénes devenimos entre los contenidos teóricos y las formas metodológicas. Mediante este trabajo, aspiramos a continuar los diálogos con el variado universo narrativo en el ámbito de la educación universitaria. (shrink)

El presente trabajo se ofrece como un ejercicio meta-analítico que recompone decisiones metodológicas y recupera emergentes del trabajo de campo llevado adelante en el marco de una investigación orientada a interpretar los procesos comunicativos que tienen lugar en el entorno virtual del ISFD Almafuerte de la ciudad de Mar del Plata. El escrito se configura a partir de relatos desde los que se propone considerar la condición biográfica y sensible como un emergente ineludible de la investigación educativa. Desde el (...) enfoque narrativo, la propuesta toma como punto de partida la consideración del hecho educativo como un fenómeno esencialmente comunicacional en el que los procesos comunicativos se conciben como prácticas sociales, espacios de interacción y de producción de sentido en los que los sujetos se constituyen. Desde esta perspectiva, se propone un itinerario por escenas y gestos que hablan sobre la práctica profesional de docentes y permiten recuperar la velada condición sensible que habita en sus historias y en su quehacer cotidiano como educadores y educadoras. En términos epistemológicos y metodológicos se plantea que la consideración de la condición biográfica descanoniza modos tradicionales de hacer investigación y se constituye no sólo como una clave en la configuración de las experiencias vitales y profesionales de quienes ofrecen sus relatos, sino también para quien investiga e interpreta. El neoliberalismo y la financiarización de la economía han generado una transformación en los mercados laborales, impactando sobre la dualización de las ciudades. La pandemia originada por la COVID-19 profundizó estos procesos haciendo pagar los principales costos a las mujeres. En este contexto, el derecho a la ciudad se puso en discusión. En el presente artículo se mostrará un caso específico, la polémica que se estableció en Mar del Plata y Batán sobre cuáles eran las consecuencias socioeconómicas de la (...) pandemia, cómo debían resolverse, qué estatus tenían las partes en el litigio y cuál fue el rol de las mujeres en este proceso. Se discutirán aspectos centrales relacionados con el modo en el que la ciudad reconfigura el proceso de expulsión de los mercados laborales y la distribución de la salud y cómo los comités barriales de emergencia emergen como escenario de un antagonismo social. Por último, se analizará la ocupación y el uso del espacio público, la demanda y la transformación de las instituciones en el nivel local y las dimensiones políticas de resignificación de las ciudades. En este artículo me dispongo a recuperar la experiencia de investigar la vida de seis profesores memorables de la Escuela de Educación Secundaria Nº19 de la ciudad de Mar del Plata, dando cuenta del giro sensorial que dio la investigación al tematizar la intimidad de quién la narra. Identificar las tramas que intervienen en la composición de la memorabilidad en las biografías de los profesores memorables, no fue un proceso directivo, desde arriba y a priori, sino que por el (...) contrario implicó una íntima relación de valorización entre la narradora y los profesores de nuestras prácticas docentes. En cuyo devenir pude reconocer las implicancias de mi propia biografía escolar y profesional, entrenando mi voz de investigadora se coló mi voz de profesora y de cantante, está última en analogía con el lenguaje musical posibilitó relatos consentidos con la intimidad de esta investigación. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions, but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends (...) on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as `thick resources with dynamic content'. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law's past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present. (shrink)

This book provides a collection of 11 cutting-edge essays by leading young scholars, challenging long-held assumptions and offering new research paradigms in Philosophy of Law, in five parts: 1) methodology/metatheory; 2) reasoning/evaluating; 3) values/the moral life; 4) institutions/the social life; and 5) the global/international dimension.

This paper considers the similarities between Adam Smith's device of the impartial spectator and the use of perspectival devices in common law reasoning. The paper adopts a reading of Smith's device as one involving the exercise of imaginative sympathy by an ordinarily virtuous, and culturally and historically situated, spectator who does not have a stake in the outcome of the scene being evaluated. The point here is to show that the impartial spectator is 1) a device of common, ordinary virtue (...) – both in the sense of being located in a culture at a specific point in time, and in the sense of possessing only moderate, achievable virtues ; and 2) a device that enables a focus on a situation, which requires imaginative work, emotional engagement and careful, particularised description. Having so modelled Smith's device, the paper shows the similarities between it and the use of perspectival devices in common law reasoning, specifically here via the ‘right-thinking member of society' test in defamation law. This paper argues that concepts of legality in legal theory can be profitably understood as being underwritten by modes of spatio-temporal objectification. In the first part of the paper, a scheme of such modes is provided, and a map of jurisprudential inquiries is thereby offered. In the second part of the paper, two concepts of legality – underwritten by two different modes of spatio-temporal objectification – are analysed. The analysis shows how both concepts of legality lead to different sets of (...) prescriptive resources as to the evaluation and design of legal systems. Finally, it is argued that the response of legal theory to practical challenges within the public sphere cannot afford to be based on any one concept of legality. Rather, we need to be pluralists about concepts of legality, recognising the limitations of any one such concept – represented, in this paper, by way of spatio-temporal objectification that underwrites those concepts. A crisis in legal theory can- not be claimed on the basis of any alleged lack of correspondence between any one concept of legality and reality. On the contrary, a crisis will ensue to the extent that legal theory becomes dominated by theoretical imperial- ism, namely, by the belief that any one concept of legality is capable of capturing the world as it is, and, therefore, also capable of standing as a foundation for a prescriptive agenda. The vice of theoretical imperialism in- duces anxiety over the identity of a discipline, and leads to a quelling of the very theoretical diversity that is required for an ethical response to the spe- cific complexity of the public sphere.Resumen:En este artículo se sostiene que los conceptos de legalidad, dentro de la teoría del derecho, pueden entenderse con mayor provecho si se piensa que están determinados por modos de objetivación espacio-temporal. En la primera parte se presenta un esquema de tales modos y, de esa manera, se ofrece un mapa de las investigaciones iusfilosóficas. En la segunda parte, se analizan dos conceptos de legalidad —determinados por dos modos diferentes de objetivación espacio-temporal—. El análisis muestra cómo ambos conceptos de legalidad conducen a diferentes conjuntos de fuentes prescriptivas para la evaluación y el diseño de los sistemas jurídicos. Finalmente, se sostiene que la respuesta de la teoría del derecho a los problemas prácticos del ámbito público no puede basarse en un solo concepto de legalidad. Por el contrario, es necesario ser pluralistas sobre los conceptos de legalidad y reconocer las limitaciones de cada uno de ellos —representados, en este ensayo, por la objetivación espacio-temporal que los suscribe—. No se puede asegurar que la teoría del derecho esté en crisis sobre la base de una presunta falta de correspondencia entre algún concepto de legalidad y la realidad. Por el contrario, aquella se generará en la medida en que la teoría del derecho llegue a estar dominada por un imperialismo teórico, a saber, por la creencia de que cualquier concepto de legalidad es capaz de capturar el mundo tal como es, y, por lo tanto, que es capaz de erigirse como fundamento para una agenda prescriptiva. El vicio de un imperialismo teórico induce una inquietud sobre la identidad de una disciplina, y conduce a sofocar la diversidad teórica que se requiere para dar una respuesta ética a la complejidad concreta del ámbito público. This collection of original essays brings together leading legal historians and theorists to explore the oft-neglected but important relationship between these two disciplines. Legal historians have often been sceptical of theory. The methodology which informs their own work is often said to be an empirical one, of gathering information from the archives and presenting it in a narrative form. The narrative produced by history is often said to be provisional, insofar as further research in the archives might falsify present understandings (...) and demand revisions. On the other side, legal theorists are often dismissive of historical works. History itself seems to many theorists not to offer any jurisprudential insights of use for their projects: at best, history is a repository of data and examples, which may be drawn on by the theorist for her own purposes. The aim of this collection is to invite participants from both sides to ask what lessons legal history can bring to legal theory, and what legal theory can bring to history. What is the theorist to do with the empirical data generated by archival research? What theories should drive the historical enterprise, and what wider lessons can be learned from it? This collection brings together a number of major theorists and legal historians to debate these ideas. (shrink)

Imagining Law. Conversing, Listening, Feeling, Hesitating This contribution is a response to four comments on Artefacts of Legal Inquiry (2020) by Adriana Alfaro Altamirano, Iris van Domselaar, Claudio Michelon, and Greg Walker. It discusses four themes by way of response to each commentator: conversing, listening, feeling, and hesitating.

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

Este trabajo profundiza en un momento importante en la historia de la comunicación como lo fue el de la difusión de la imprenta y el desarrollo de las técnicas del grabado aplicadas a la impresión. Se estudian las imágenes del libro bíblico del Apocalipsis, ilustrado por el artista alemán Alberto Durero a finales del siglo XV. Para ello se ha ahondando en el contexto histórico en el que fueron producidas, en la personalidad y circunstancias que rodearon la vida del artista (...) y en las propias imágenes xilográficas rastreando sus antecedentes y características propias. This work focuses on an important moment in the history of communication such as the diffusion of the printing press and the development of the engraving techniques applied to printing. It studies in depth the images of the biblical book of the Apocalypse illustrated by the German artist Alberto Durero by the end of the fifteenth century. This article analyzes the historical context where they were produced, the personality of the artist and the circumstances surrounding his life, and the very own xylographic images, whose antecedents and characteristics are traced. The study of corporate social responsibility has been the object of much research in recent decades, although there is a need to continue investigating its benefits as a marketing tool. In the current work we adopt a multi-dimensional perspective of social responsibility, and we carry out market research to determine the perceptions of users of mobile telephone services about economic, legal, ethical and social aspects of their operating companies. With these data we determine the structure and components of the concept (...) of social responsibility. Subsequently, this is related with the overall evaluation of the service and loyalty by means of a model of structural equations, in order to determine the influence of corporate social responsibility on these concepts, and hence its benefits as a commercial tool. What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. -/- Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. To imagine, in turn, is to enter a distinctive epistemic frame where we temporarily suspend certain epistemic norms and commitments and participate actively along a spectrum of affective, sensory and kinesic (...) involvement. -/- The book argues that artefacts and related processes of imagination are valuable insofar as they enable inquiry in adjudication, ie the social (interactive and collective) process of making insight into what values, vulnerabilities and interests might be at stake in a case and in similar cases in the future. -/- Artefacts of Legal Inquiry is structured in two parts, with the first offering an account of the three models of inquiry, artefacts and imagination, and the second examining four case studies (fictions, metaphors, figures and scenarios). -/- Drawing on a broad range of theoretical traditions – including philosophy of imagination and emotion, the theory and history of rhetoric, and the cognitive humanities – this book offers an interdisciplinary defence of the importance of artefactual language and imagination in adjudication. This article explores the maternal experiences of a heterogeneous group of 26 mothers from Granada. The aim is to analyse the needs and demands that these women express with regard to childrearing, using a qualitative methodology. The authors conducted in-depth interviews and analysed the discourses of the mothers following the hermeneutical method. The variables used for sample selection and the themes that emerged during the interviews revealed that the discourses of the mothers revolve around three dimensions: indifference, demands and resignation (...) regarding support for childrearing. The lack of paternal involvement in childrearing appears as a transversal dimension. This article shows that the material conditions of existence marked the differences in the responses of the women regarding support for childrearing, while the sexual division of labour and gender inequalities unified their discourses. Review Essay of Stephen P. Turner, Explaining the Normative, 2010.

The concept of corporate social responsibility is becoming integral to effective corporate brand management. This study adopts a multidimensional and cross-country perspective of the concept and analyses consumer perceptions of behaviour of four leading consumer products manufacturers. Data was collected from consumers in two countries – Spain and the UK. The study analyses consumers’ degree of interest in corporate responsibility and its impact on their perception about the company.
